The Petition for leave under Clause XII of the Letters Patent is filed in a Commercial Arbitration Petition under Section 9 of the Arbitration and Conciliation Act 1996 ("Arbitration Act"). 2.

The 1st Respondent is the Award Debtor. It is said to have assets within the jurisdiction of this Court including an amount owed by the 2nd Respondent to the 1st Respondent, and which lies in the bank accounts in Mumbai. There is, however, another asset which is outside the territorial jurisdiction of this Court but is in the 27th August 2018

13-LPETN282-18.DOC position and control of 2nd Respondent, a company with its registered office in Mumbai and a subsidiary of 1st Respondent. 3.

I am satisfied that with leave granted under Clause XII of the Letters Patent, this Court will have the jurisdiction to entertain and try the Commercial Arbitration Petition.
