Ms. P.H. Kantharia, Govt. Pleader a/w. Ms. Deepali Patankar, AGP for Respondents 1,4,5,9.

CORAM : PRADEEP NANDRAJOG,C.J. & N.M. JAMDAR, J.

DATE : 20 JUNE 2019.

P.C. :- Each paragraph of the Writ Petition comprises one sentence. Paragraph span as many as 3 to 4 pages. There is no flow emerging from the pleadings targeted towards the destination i.e. the prayer made. Counsel for the Petitioner concedes that the Petition to prolix and the pleadings are floating.

2.PIL 27.19.doc 2.

Counsel seeks leave to withdraw the Writ Petition provided the liberty be granted to file a fresh Petition making same prayer but after proper pleadings confirming to the Rules of the pleadings contained in the Order VI of the Code of Civil Procedure, 1908. The same required a narration of the material facts to be put concisely. The concise statement of material facts should bring out the claim on which the prayer is made if required material particulars as envisage by Rule 4 of Order VI to be pleaded. The pleading has to be divided into paragraphs, numbered consecutively, meaning thereby if a narrative of a separate fact is pleaded, the same has to be in a separate paragraph required by sub-Rule (2) of Rule 2 of Order VI of the Code of Civil Procedure.

3.

Granting liberty as prayed for, the Petition is disposed of as not pressed.
