The plaintiff has taken out Notice of Motion No.1477 of 2014 for injunction, appointment of Court Receiver etc. in relation to flat no.72, 7th floor, Montblanc, 67A, Nepean Sea Road, Mumbai-400 006 and the defendants have taken out Notice of Motion No.34 of 2015 for appointment of Court Receiver and injunction in relation to flat no.701, 7th floor, Rajmandir, Off Yari Road, Mumbai-400 061. KJ

NMS1477.14-23 Both the counsel state that both the Notices of Motion can be disposed in terms of prayer clause-(b).

In view thereof, both the Notices of Motion are disposed in terms of prayer clause-(b) which reads as under :- NOTICE OF MOTION NO.1477 OF 2014 (b) that pending the hearing and final disposal of the suit, the defendant, his servants and agents be restrained by an order and injunction of this Hon'ble Court from in any manner intermeddling with or dealing with or disposing of or transferring or alienating or encumbering or parting with possession of or creating any third party rights in respect of the estate left by the deceased Kamla Hira Sadarangani including the assets set out in Exhibit-"A" to the plaint or any part thereof.

NOTICE OF MOTION NO.34 OF 2015 (b) that pending the hearing and final disposal of the suit, the plaintiff, her servants and agents be restrained by an order and injunction of this Hon'ble Court from in any manner intermeddling with or dealing with or disposing of or transferring or alienating or encumbering or parting with possession of or creating any third party rights in respect of the estate left by the deceased Kamla Hira Sadarangani including the assets set out in Exhibit-"B" to the plaint or any part thereof.

Notice of Motion No.1010 of 2016 be listed for hearing on 20.2.2017.
