2. The counsel for the Plaintiff submits that the claim of the Plaintiff has been amicably settled. Therefore the Plaintiff seeks to withdraw the present Suit. There is no caveat against release of the Defendant vessel.

3. In view of the aforesaid the Defendant vessel is ordered to be released. In view of urgency, instrument of release is dispensed with.

4. The Plaintiff undertakes to pay poundage as per rules within two weeks from today. Undertaking is accepted.

5. Liberty to communicate this order along with the letter from the Sheriff of Mumbai to all Authorities/Port and Customs by Fax/Email/hand delivery.

6. All parties to act on the ordinary copy of this order duly authenticated by the Associate of this Court.
