By Interim Application No.2513/2021, applicant/original defendant No.7 is seeking direction to the registry to accept the written statement on behalf of the said defendant.

It is pointed out that the said defendant was served during Covid period some time in June, 2020 and the written statement was sought to be filed on 24th July, 2021. But, the registry refused to accept the same as a consequence of which, the present application for taking the written statement on record was filed on 11th October, 2021. 1/2

By inviting attention of this Court to the orders passed by the Hon'ble Supreme Court in Suo Moto Writ Petition No.3 of 2020, learned counsel appearing for defendant No.7 submitted that the period between 15th March, 2020 and 15th March, 2022 was covered by the orders passed in the aforesaid Writ Petition by Hon'ble Supreme Court, as a consequence of which, period of limitation stood extended upto 15th March, 2022. 4.

Defendant No.7 having approached registry of this Court on 24th September, 2021 and thereupon, filed this application on 11th October, 2021, clearly shows that the said defendant is eligible for the reliefs granted by the Hon'ble Supreme Court concerning limitation in the light of the Covid19 pandemic. Affidavit of service is handed over, demonstrating that the application was served on the plaintiff. The same is taken on record. 5.

There is no objection raised to the present application on behalf of any party in the present proceedings.

In the light of the above, application is allowed and the Registry is directed to take on record the written statement filed by defendant No.7. 7.

The learned counsel for defendant No.12 submits that reply to the Interim application filed by the plaintiff may be taken on record, although it is beyond the time period specified by an earlier order of this Court. 8.

In the interest of justice, defendant No.12 is permitted to file the affidavit in reply within one week from today. (MANISH PITALE, J) Priya Kambli 2/2
