Learned counsel appearing for the Applicant on instructions of the Applicant seeks permission to withdraw this Notice of Motion in light of the observation made in the order dated 25th March 2013 that the relief of the nature sought can be granted only at the time of final hearing.

Accordingly, we dispose of the Notice of Motion as withdrawn.

Considering the fact that the relief is claimed on the basis of the ailment of the mother of the Applicant, we direct that the Appeal shall be listed on the final hearing cause list of the week commencing from 13th December 2016 in the first 10 matters.
