The counsel for the defendant further states that the defendant have preferred an appeal against the order dated 13th June, 2016 but when they moved an application for stay, the court directed them to deposit some amount, which the defendant expressed cannot be done and therefore, the stay was rejected. Hence there is no impediment for going ahead with the matter.
The defendant having failed to comply with the preconditions for leave to defend as directed in the order dated 13th June, 2016, the plaintiff will be entitled to a decree. Gauri Gaekwad
