This petition under Article 226 of the Constitution of India challenges the order dated 9th August, 2017 passed under Section 245D(4) of the Income Tax Act,1961 by the Income Tax Settlement Commission (the Commission). The impugned order dated 9th August, 2017 has rejected the petitioner's application for settlement for failure to make a true and fully disclosure of his income in the settlement application filed before it.

Mr. Khare, learned Counsel appearing for the petitioner, on instructions, seeks to withdraw this petition with liberty to take such Uday S. Jagtap
