The relief sought by the Defendant in the Notice of Motion is to dismiss the suit or stay the hearing of the suit and to refer the matter for arbitration. This Notice of Motion has been taken out in September, 2010. The issues were framed on 18th December 2014, the evidence of PW-1 was recorded on 13th March 2015, the documents were received in evidence on 13th March 2015 and Commissioner to record evidence was also appointed on the same date. Therefore, nothing survives in the Notice of Motion.
