Learned Senior counsel for the petitioners states that the representation of the petitioners for extension of time to vacate the transit accommodation is pending with the Vice President and Chief Executive Officer, MHADA. Learned Senior counsel further states

that in the entire scheme consisting of several societies, 2360 slum dwellers have been eligible for alternate accommodation and 2100 slum dwellers have already been shifted to the permanent alternate accommodation and only 260 slum dwellers are left to be rehabilitated. Learned Senior counsel states that only 2 buildings are left to be constructed and the construction is in progress and the same would be completed by end of the year 2016.

Learned counsel for the MHADA confirms the representation of the petitioners is pending with VP & CEO, MHADA. She states that the representation will be considered and decided after hearing the petitioners and the Corporation.

In the circumstances, in my view, no purpose would be served in keeping the Writ

Petition pending. Until the representation is decided, no coercive steps shall be taken by MHADA and Corporation. In the event, any adverse order is passed against the petitioners, the same shall not be implemented for a period of three weeks from the date of communication of the decision to the petitioners.

The Petition is disposed of in the aforesaid terms.
