In view of the separate order passed today in notice of motion no.705 of 2014, by consent of the counsel for the parties, the chamber summons is taken up for hearing.

This chamber summons is taken out by the plaintiff for bringing on record the legal heirs of defendant no.1, who expired on 13th December 2011. The counsel for defendant no.2 has no objection if the chamber summons is allowed.

14.CHS.1274.12 s.384.2012.doc Therefore, for the reasons mentioned in the affidavit-in-support and since defendant no.2 also has no objection for allowing the chamber summons, the chamber summons is allowed in terms of prayer clauses (a), (b) and (c). The plaintiff to carry out amendment to the plaint within two weeks from today. A copy of the amended plaint has to be served upon the defendants on or before 7th March 2015. Should the defendants/newly added defendants wish to file any reply and/or amend the written statement already filed or file additional written statement, the same to be filed within three weeks of receiving the amended plaint.
