The Petitioner who is the sister of one Mandar Ulhas Sabnis, says that he has been missing and not heard of since 7th September 2003. The Petitioner has in the meantime filed a Petition for a succession certificate. That Petition is pending. A Missing Person's complaint was registered with the Crime Branch and CID on 16th September 2003. The Police Authorities have issued certificates that are annexed to the Petition. A newspaper publication has been issued on 20th September 2003 in Loksatta and in Daily Vartahar on 13th October 2003.

The Police Authorities at MHB Colony Police Station have issued certificates saying that Mandar Ulhas Sabnis is still not traceable. Copies of two certificates are annexed at Exhibit "C" and

923-MPT148-15.DOC Exhibit "D" to the Petition. The Petitioner says that she has not found any Will that was left by him. He was a bachelor and the parents of the Petitioner passed away earlier. The Petitioner would be the only heir of the deceased if he is declared dead. 3.

The Petition is made absolute in terms of prayer clause (a). 4.
