After the matter is heard at some length, it is agreed between learned Counsel for the parties that the impugned award dated 6 August 2013 may be aside by consent and the reference be remanded to a new arbitrator for a fresh hearing in accordance with law. Accordingly, Mr.Pradip V. Bavkar, Retired Principal District & Sessions judge, is appointed as a sole arbitrator to hear the disputes between the parties. The learned arbitrator will permit the Petitioners herein to file a statement of defence in the arbitration reference and also permit the parties to lead such evidence as the parties may desire to produce. The learned arbitrator shall endeavour to dispose of the reference as expeditiously as possible.

The arbitration petition is accordingly disposed of. (S.C. GUPTE, J.)
