Mr.Shah appearing on behalf of the Applicant states on instructions that the bank guarantee pursuant to the earlier order of this Court dated 24 July 2008 is ready and will be furnished to the Commissioner of Service Tax on or before 18 November 2015. If the same is furnished, it shall be accepted without prejudice to the rights and contentions of all parties in the appeal.

Since this is the only relief which is sought, we extend the time for furnishing the bank guarantee till 18 November 2015. The Notice of Motion stands disposed of with this direction. No costs.
