1. Mr. Dighe for respondent no. 1 points out that this petition does not survive and he tenders an affidavit of respondent no. 1 affirming that pursuant to her being declared surplus and having joined other institutions and having superannuated nothing will survive in this petition.

2. Mr. Chavan agrees that in view of the contents of the affidavit, the petition is infructuous and may be disposed except that respondent no. 1 cannot now have any other claim against the petitioner. Mr. Dighe confirms that respondent no 1 will have no claim. In view of the above, by consent the petition is disposed as infructuous.
