This is a mother's Petition for being appointed as a guardian of her minor daughter. The Respondent is the Petitioner's estranged husband. There are allegations in the Petition of ill-treatment to the Petitioner by the Respondent and his family, inter alia because the Petitioner gave birth to a female child. A divorce Petition is also pending. Proceedings under the Domestic Violence Act, criminal proceedings and other actions have also been initiated. The minor Reshma is in the custody of the mother. Reshma was born on 23rd June 2005 and is, therefore, today about 11 years old. 8th June 2016

In my view, it is necessary that the custody of Reshma continue with the mother and that the mother be appointed her guardian.

The Petition is made absolute in terms of prayer clauses (a), (b) and (c).
