By the impugned order, the Customs, Excise and Service Tax Appellate Tribunal, West Zonal Bench at Mumbai has proceeded to set aside the penalty. The Appellant applied 1/2

42-CEXA-28-07.doc rectification and by an order dated 16 July 2007, the direction to pay interest on the confirmed demand has been ordered to be deleted.

In view of the order dated 16 July 2007, the learned Counsel appearing for the Appellant states on instructions that the Appellant does not want to press the Appeal. Accordingly, the Appeal is disposed of, as not pressed.
