Heard the learned counsel for the applicant and Mr. A. D. Kamble, officer of the Court Receiver. None for the Respondents, though duly served. This Chamber Summons is for discharging the Court Receiver without passing of account, but on payment of cost, charges and expenses if any. The learned counsel for the applicant submits that applicants are ready and willing to pay all charges of the Court Receiver within four weeks from the date of communication in writing. Statement is accepted.

13 chs 1172-15=.doc learned counsel for the applicant and the averments made in affidavit in support of Chamber Summons , I am satisfied that the Applicant has made out a case for allowing the present Chamber Summons.

Hence, the following order:

a) Chamber Summons is allowed in terms of prayer clause (a) which reads thus:

"a) The Court Receiver, High Court, Bombay be discharged without passing of accounts on payment of costs, charges and expenses if any, by the petitioner."

b) Applicant to pay all charges, costs of the Court Receiver in the office of Court Receiver, High Court, Bombay within four weeks from the date of communication.

c) Chamber Summons stands disposed of accordingly.
