Mr.Halai, learned Counsel appearing for the Petitioner seeks to withdraw the petition with liberty to file a fresh petition as an assessment order relating to Assessment Year 2011-12 has been passed consequent to the reopening notice dated 15 March 2013.

In the above, the petition is dismissed as withdrawn with liberty as prayed. No order as to costs.
