IN THE HIGH COURT OF JUDICATURE AT BOMBAY

ORDINARY ORIGINAL CIVIL JURISDICTION NOTICE OF MOTION NO. 1846 OF 2015 IN SUIT NO. 976 OF 2011 Glenmark Pharmaceuticals Limited ...Plaintiffs

Versus

Wockhardt Limited ...Defendants Ms. Miloni Gala, i/b Mr. M.A. Mahadgut, for the Plaintiffs. Mr. Abbas Mandviwala, i/b Raval Shah & Co., for the Defendants. CORAM: G.S. PATEL, J DATED:

11th August 2016 PC:- 1.

The Notice of Motion is for recalling an order dated 17th August 2015 (S.J. Kathawalla, J.). I do not see what there is to recall. By that order, Mr. Justice Kathawalla directed the learned Commissioner to record the cross-examination of one Mr. Sandeep Dudhwadkar and to submit his report as Mr. Dhdhwadkar is a witness who produced a certificate regarding a set of digital documents under Section 65-B of the Evidence Act. One look at Section 65-B makes it clear that the person who produced such a certificate can surely be cross-examined on the correctness of the various statements that are made in that certificate. 11th August 2016

235-NMS1846-15.DOC 2.

The Notice of Motion for recall is rejected. It is dismissed with no order as to costs.
