This petition challenges orders passed, respectively, by Commissioner of Police and State of Maharashtra, on 9 July 2012 and 13 September 2012, under Section 33 of Bombay Police Act, 1951 and Rules framed therein, in particular, 'Public Entertainment Rules'. Based on the alleged breaches by the Petitioner of these rules, his licence was suspended for thirty five days and this order was confirmed in an appeal by the State Government. During the pendency of the petition, Public Entertainment Rules themselves have been cancelled. The Police now have no right to issue or renew any licence issued thereunder. In the premises, the present writ petition has become infructuous and is disposed of as such. (S.C. GUPTE, J.)
