Admittedly, there is a decree passed against the Applicant. The Applicant states that he has not been able to file an appeal yet because, he is unable to raise funds to file an appeal. Certainly, the Applicant could have approached the Maharashtra State Legal Aid Services Authority for legal aid. Therefore, there is no impediment with the Insolvency Registrar going ahead with adjudication and further process.

Notice of motion is dismissed with liberty to apply as and when the Judgment Debtors succeeds in appeal. (K.R.SHRIRAM, J.) .
