Learned Counsel appearing for the Petitioner having taken instructions from his client states that writ petition and notice of motion can be disposed of by directing Assistant Municipal Commissioner, !-Ward, MCGM - Respondent No.3 herein to decide the Petitioner's application dated 22nd January 2016 made under the provisions of Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014.

In view of the statement, we dispose of the writ petition as well as the notice of motion, with a direction to Respondent No. 3 to decide the Petitioner's application dated 22nd January 2016, copy of which is annexed at Exhibit-B to the notice of motion, as expeditiously patilsr 1 / 2

as possible and at any rate within the period of four weeks from the date of receipt of a copy of this order. The said application shall be decided after giving an opportunity of hearing to the Petitioner. The Petitioner shall remain present before Respondent No.3 on 17th October 2016.

Writ Petition as well as notice of motion stand disposed of.

It is clarified that this Court has not gone into merits of the matter and the said application of the Petitioner shall be decided by Respondent No. 3 independently, on its own merits and in accordance with law.
