Heard the learned Advocates appearing for the parties. The claim of the Applicant / Petitioner is approximately in the sum of Rs.1,37,00,000/- against the Respondent. The claim of the Applicant / Petitioner is secured by mortgage of immovable property in favour of the Applicant / Petitioner. In view thereof, no case for appointment of the Provisional Liquidator is made out. Needless to add that the Respondent shall not be able to create any third party rights in respect of the property mortgaged in favour of the Applicant / Petitioner.
