This writ petition challenges Part-1 as well as Part II awards passed by the Labour Court at Mumbai on a reference made to it under Section 12(5) of the Industrial Disputes Act, 1947. After the matter is heard at some length, it is agreed between learned Counsel for the parties that the writ petition may be decided by this court without stating any reasons. Accordingly, the petition is disposed of in terms of the following order :

(i) The Respondent employer shall pay a sum of Rs.3,00,000/- to the Petitioner employee in full and

31. WP 2807-19.doc final settlement of the latter's claim in the present petition. After payment of this amount, neither party shall have any claim against the other in respect of the subject matter of the present petition;

(ii) The Petitioner may apply for payment of provident fund and pensionary dues. The Respondent shall co-operate with the Petitioner in the matter of such application. The Application shall be decided on its own merits;

(iii) This order is passed in the presence of the Petitioner.
