The learned counsel appearing for the applicant states that the respondent has been served and affidavit of service is already filed by the applicant. None appears for the respondent though served and no reply has been filed. There is a delay of 26 days in filing the arbitration petition.

In para 2 and 3 of the affidavit in support of the notice of 1/2

8-NMS-2606-2016 motion, the applicant has explained the date of receipt of the impugned award from the learned arbitrator. I am satisfied that the applicant has satisfactorily explained the delay of 26 days in filing arbitration petition. Notice of motion is accordingly made absolute in terms of prayer clause (a).

The applicant is directed to remove all other office objections within two weeks from today. It is made clear that no further extension would be granted. If the petition is numbered, the same shall be placed on board for admission on 14th March, 2018. Notice of motion is allowed in the aforesaid terms. No order as to costs. (R.D. DHANUKA, J.) 2/2
