For the reasons set out in the ad-interim order dated 4th October 2016, that order is confirmed as the final order on this Notice of Motion.

In addition, there will also be an order in terms of prayer clause (b) of the Notice of Motion, i.e., the interim relief in passing off.

The Notice of Motion is disposed of in these terms with costs. In addition, the Plaintiff will be entitled to actual costs of this Notice of Motion to be recovered at the time of final disposal of the suit.
