Heard the learned counsel appearing for the parties. On instructions, the learned counsel for both parties agree that the matter is amicably resolved on the following terms :
i) The parties agree that the Respondent undertakes to pay a sum of Rs.1,50,000/- (Rupees One Lakh Fifty Thousand Only) to the Petitioner in full and final settlement of their claim. The aforesaid amount will be paid subject to statutory deductions as applicable. Borey 1/2
spb/ 904cp924-14.sxw ii) The Respondent undertakes that the aforementioned payment will be made to the Petitioner within a period of 10 working days from today.
iii) Upon receipt of the entire amount as agreed in Clause 1(i) mentioned above, all claims of the Petitioner against the Respondent which are the subject matter of the present Petition shall stand fully satisfied and extinguished and the Petitioner shall have no claim of whatsoever nature against the Respondent Company. The present company petition is, therefore, disposed off on the aforementioned terms.
