By consent of the parties, the following order is passed :- a).

The impugned award dated 19th September, 2009 rendered by the learned arbitrator is set aside. b).

The parties have no objection if the arbitral proceedings filed by the respondent are remanded to the learned arbitrator and is heard afresh. The petitioner undertakes to file the written statement before the learned arbitrator within four weeks from the date of service of the statement of claim and documents and serve a copy thereof upon the respondent's advocate simultaneously. c).

The respondent has agreed to serve a copy of the 1/3

statement of claim along with all the documents, which were relied upon by the respondent before the learned arbitrator to the petitioner within two weeks from today. Both the parties have agreed that the pleadings and all the notices shall be served upon learned advocates appearing for the parties before the learned arbitrator. d).

The learned arbitrator shall decide the matter afresh without being influenced by the observations and conclusions rendered in the impugned award and shall decide the same in accordance with law.

The arbitration petition is disposed of in aforesaid terms. No order as to costs.
