The learned counsel appearing on behalf of the Respondent No.5 Shri Jehangir Khan tenders an affidavit of one Shaista Majid Khan the Proprietor of the Respondent No.5 bearing today's date. In view of the said affidavit, the learned counsel appearing on behalf of the Petitioner Shri D H Shukla, on instruction of the advocate on record Shri H S Ansari, seeks withdrawal of the above Writ Petition to approach the High Power Committee (HPC) in respect of the grievances of the Petitioner, if any. The above Writ Petition is accordingly allowed to be withdrawn and dismissed as such. Needless to state that in so far as the grievances of the Petitioner are concerned, which according to the Petitioner are not addressed by the affidavit, the contentions of the Petitioner are kept open.
