This Chamber Summons is for amending the plaint to bring the subsequent event of change in the constitution of the plaintiff on record. During the pendency of the suit, some of the trustees of

* 2/3 * the plaintiff no.1, Trust expired and the persons named in the Schedule to the Chamber Summons have been appointed in their place. The new trustees are sought to be brought on record by this Chamber Summons.

Mr. Kaushik, the learned Advocate appearing for the plaintiff states that, after the writ of summons was served upon the defendants, none of them have appeared before the Court to contest the suit. In that circumstance, the Chamber Summons need not be served upon the defendants. Since the Chamber Summons is only to bring the present trustees on record as the plaintiffs, the same is allowed in terms of prayer clauses (a) and (b).
