After som arguments, Mrs. Moily for the Petitioners seeks leave to withdraw the Miscellaneous Petition with liberty to adopt appropriate civil proceedings in regard to the title to the property or ancestral property held by parties' ancestor Kalu Govind Gamre or his wife Draupadi Kalu Gamre or both. All contentions in that behalf are expressly kept open. It is also specifically clarified that any Letters of Administration obtained by the Respondents to this Miscellaneous Petition to the estate of Shalini Motiram Mohite (one of the daughters of Kalu and Draupadi Gamre) do not decide, determine, confer or establish title to any property that was held by 10th October 2016

12-MPT12-16.DOC Kalu Gamre or Draupadi Gamre or both. All questions of title have to be decided in appropriate civil proceedings in a Court of competent jurisdiction.
