On hearing the learned counsel for the parties for quite sometime and on perusal of the judgment reported in 2003 (4) Mh.L.J. 287 and the unreported judgment of this Court dated 06/10/2016 in the Writ Petition No. 7961 of 2016, the writ petition is disposed of with the consent of the learned counsel for the parties on the following terms:

(i) The Chief Judge of the Small Causes Court, Mumbai is requested to decide the Election Petition filed by the petitioner bearing no. 29 of 2017 within 6 weeks.

(ii) The by-election to Ward no. 62 of the Municipal Corporation, Mumbai should not be conducted till the election petition is decided. (iii) No order as to costs.
