The Foreign Adoption Petition proposes the adoption of a female minor, Aachal. She was born on 2nd May 2017. She was relinquished by her biological unmarried minor mother and her grandmother to the Child Welfare Committee, Thane a few days later on 9th May 2017. She was placed in safe custody of the Petitioner institution World India Trust, Nerul, Navi Mumbai on that date.

The Child Welfare Committee, Thane has, after following necessary procedures, declared the child legally free for adoption.

The undertaking / Affidavit of the Petitioner and the No Objection Certificate of CARA are on record.

This is a single-parent adoption proposal. The proposed adoptive mother is from America. She lives in New York. She is about 39 years old. She is unmarried. She has no biological children of her own.

The medical reports of the child are on record. The Medical Examination Report of the minor shows her VDRL report dated 6th March 2018 positive and Repeat Syphilis test (FPR) dated 7th March 2018 negative. Her mental development is normal. The report observed mild physical delay in her development. The adoptive mother has counter-signed this report. The medical report of the adoptive mother does not show any abnormalities or any adverse condition. The HIV reports are negative. 6.
The adoptive mother works as a Health System Pharmacist with NYC Health+ Hospitals, Bellevue, New York with an annual salary of USD 136,430. The other financial documents are on record. There is also a child care plan that is satisfactory. 7.
There is a guardianship undertaking dated 11th July 2016 by the adoptive mother's first cousin and his wife. They live in New York, U.S.A. and agree and undertake to look after the minor should the need arise and in the event of any unforeseen mishap.

The home study report says that the adoptive mother is capable of providing the child with a safe, stable and nurturing environment. It recommends the adoption. The other documents are in order.

I have seen the scrutiny report presented by Mr O Hareendran, Scrutiny Officer of the Indian Council of Social Welfare, which is on record.
10. Having regard to these circumstances, I will allow the Petition. The Judge's Order is separately signed.
11. The Registry will get the Petition with all its annexures and all orders, including the signed Judge's Order, scanned. These digital copies are to be preserved. A soft copy may be given to the Advocate for the Petitioner free of cost on a pen drive provided by the Advocate for the Petitioner for the same. The Registry will ensure that the scan of the Judge's Order is a properly calibrated colour scan.
