Parties have amicably settled the dispute and have filed Consent Terms which are taken on record. Respondent is present in Court. Appellant, who is permanently residing in United States has given an authority letter dated 17th December, 2015, a copy of which is taken on record. 2.

Testamentary Suit is disposed of in terms of the Consent Terms. The order passed by the learned Single

2/2 APP/675/2012 Judge is accordingly set aside and the same is replaced by the Consent Terms signed by both the parties and their respective advocates which are notarized in USA and also in India. Undertaking given by both the parties in the said Consent Terms is accepted.

Appeal is allowed to be withdrawn. Proceedings are accordingly disposed of.
