The learned counsel for the respondent no.1 seeks leave to withdraw Notice of Motion No. 2417 of 2016, on which the impugned order is passed by the learned Single Judge, with liberty to file appropriate proceeding.

14-app-25-18 Leave granted. Notice of Motion No. 2417 of 2016 is allowed to be withdrawn with liberty as prayed for.

In view of withdrawal of Notice of Motion No. 2417 of 2016, the impugned order is rendered inconsequential and, therefore, same is set aside.

Appeal is accordingly disposed of. All contentions of the parties on merits are kept open.
