The Suit has been filed by the Plaintiffs as legatees under the last will and testament of one Morarji Cooverji. Plaintiff No.1 is the son of the deceased. He has obtained letters of administration with the will annexed from this court. The Plaintiffs have been seeking directions in the suit in respect of questions, which have since been fully answered by this court on a originating summons taken out in the present suit, being Originating Summons No.105 of 2012. All ten questions submitted by the Plaintiffs for the determination of this court have been answered in the Oral Judgement delivered on 27 February 2017. The Originating Summons has accordingly been finally disposed of and the suit does not survive. The Suit is disposed of in terms of the same order.
