Heard the parties through their Counsel. The grievance of the petitioner is that though the complaint has been made by her on 27/08/2015 in respect of illegal structure raised at Shivshakti Chawl, Jai Bhim Nagar, Morarji City, Mumbai - 400 024, but till date, no action has been taken in respect of the said complaint.

Having considered the submissions made by the learned Counsel for the parties, we are inclined to dispose of 1/2

28.wp 2457.15.doc this Petition by directing the Competent Authority of respondent No.2 to consider and take appropriate decision in regard to the petitioner's complaint Exhibit 'A'. The petitioner may also submit copy of the Petition along with copy of this order before the Competent Authority of respondent No.2 -Municipal Corporation. The action or steps as may be required be taken as expeditiously as possible but not later than 2 months from the date of receipt of copy of this order. Needless to say that we have not expressed our opinion about the merits of the contentions raised in the complaint or in the Writ Petition. The authority will be free to take the decision in accordance with law. If it is found that there is some illegal structure, the said Authority shall take further steps in the matter and take action after giving opportunity of hearing to all the concerned.
