Heard the learned Advocates appearing for the parties and the following order is passed by consent :

i.

The disputes between the parties arising out of the Agreement for Sale dated 8 th September, 2010 are referred to the Arbitral Tribunal comprising of Mr. Justice H.L. Gokhale (Former Judge of Supreme Court of India), Mr. Justice J.A. Patil (Former Judge of this Court) and Mr. D.G. Karnik (Former Judge of this Court).

ii.

All contentions of the parties including the contention that there is no Arbitration Agreement between the parties and that the claim is not covered by the Arbitration Agreement are kept open.

iii.

The venue of Arbitration shall be at Mumbai.

ii.

The cost of arbitration shall initially be borne by the parties equally. 2.

In view of this order, the above Arbitration Application is disposed off. ( S.J.KATHAWALLA, J. )
