IN THE HIGH COURT OF JUDICATURE AT BOMBAY

ORDINARY ORIGINAL CIVIL JURISDICTION NOTICE OF MOTION NO. 2890 OF 2016 IN SUIT NO. 1311 OF 2003 WITH NOTICE OF MOTION NO. 2810 OF 2016 Union of India ...Plaintiff

Versus

Khetan Industries Pvt Ltd & Ors ...Defendants Mr SR Rajguru, with Jyotsna Pandhi & AR Varma, for the Plaintiff.

Mr DV Deokar, with D Parikh, i/b Parimal K Shroff & Co., for Defendant No. 2.

CORAM: G.S. PATEL, J DATED:

23rd January 2019 PC:- 1.

There is a delay of 2564 and 2609 days in filing the Written Statements by Defendant No. 2 and Defendant No. 1 respectively. The suit is by the Union of India through its Salt Commissioner. Copies of the Written Statements have been served. Since the Plaintiff is Union of India, the delay by the Defendant is condoned. The alternative would be no choice but to hold the Union of India to the same stringent standard. Clearly that is not possible. 23rd January 2019

31-NMS2890-16+.DOC 2.

The Written Statements will be filed in the Registry on or before 25th January 2019.

3.

List the suit for framing issues on 11th February 2019. 4.

Both the Notices of Motion are disposed of in these terms. There will be no order as to costs.
