Challenging the rejection of his tender and invitation of fresh tender, the petitioner has approached this Court by filing this petition under Article 226 of the Constitution of India. 2.

After arguing for some time, the learned Counsel for the petitioner seeks leave to withdraw the writ petition, with liberty to the petitioner to participate in fresh tender process and with liberty to file fresh petition, if occasion so arises, raising all the grounds which have been raised in this petition.

With the aforesaid liberty, the writ petition is allowed to be withdrawn. Needless to say that the participation in the fresh tender process will not amount to waiver of grounds raised in this petition.
