The learned counsel for the appellant fairly states that about 6-7 petitions for winding up of the appellant-company were filed and in almost all the company petitions, the common order for winding up of the company was passed. It is stated that the company has not filed appeals against the order passed in 4 petitions and in that circumstance, in any case, the proceedings for winding up of the company would continue. It is stated that hearing of this company appeal would be merely academic in view of the aforesaid position.
