These notices of motion have been taken out respectively by original Defendant No.4 and original Defendant Nos.1 and 3 for condonation of delay in filing additional written statements and taking their respective additional written statements on record.

sat 2/2 nms 1610-2015, nmsl 2990-2015.doc By an order dated 18 April 2015, the chamber summons taken out by the original Plaintiff for amendment of the plaint was allowed and the Defendants were granted leave to file written statement within a period of thirty days after the service of the amended plaint. There is a short delay, respectively, of 2 months 8 days, and 105 days in filing the additional written statements by Defendant No.4 and Defendant Nos.1 and 3.

For the reasons stated in the affidavit in support of the notices of motion, both notices of motion are made absolute in terms of prayer clause (a) thereof. Such additional written statements shall be filed by the respective Defendants within a period of one week from today. The notices of motion are disposed of accordingly. (S.C. Gupte, J.)
