Primary relief sought for in the Petition was to seek extension of time for E-filing of Income Tax Returns and Tax Audit Reports up to 30th October, 2015. The Central Board for Direct Taxes (CBDT) had extended the date for E-filing of Income Tax Returns and Tax Audit Reports from 30th September, 2015 to 31st October, 2015 by order dated 1st October, 2015.

In view of the above, principal relief sought does not survive. The subsidiary reliefs sought was for a directions to the Respondents that any changes in the proforma of the forms prescribed in respect of the Tax Audit Reports and the Income Tax Returns, should be notified on the 1st S.R.JOSHI

wpl-2764-2015.sxw April of the calendar year relating to which the returns have to be filed. Mr. Suresh Kumar, learned Counsel appearing for the Respondents has no objection to the Petition being withdrawn but joins Dr. Shivram, learned Sr. Counsel in the request to keep the questions of law raised in the Petition open.

All questions of law left open, to be decided in an appropriate case.
