Mr. Kamat, counsel for applicant states that further to the order dated 17th October 2018 applicant has advertised in Free Press Journal and Navshakti the settlement and recall of winding up order, recall of admission order and withdrawal of the petition on 19th October 2018. Mr. Kamat relies on an affidavit of one Firoz Khan affirmed on 1st November 2018. Mr. Kamat also states that his instructing advocates have not received any objection or claim in response to the said notice and further states that his instructing advocates have inquired with the Company Registrar, who has informed Mr. Tripathi that they have not received any claim or objection in response to the said notice.

Petition also stands disposed with liberty to petitioner to approach this Court for revival of the petition in case of default, apart from the liberty granted by this Court in the order dated 17th October 2018. Company application (lodging) no.567 of 2018 also stands disposed.

Company to pay a sum of Rs.50,000/- as costs to Official Liquidator who shall utilise the same for office administrative expenses. The costs to be paid within three weeks from today. (K.R. SHRIRAM, J.) Gauri Gaekwad
