This notice of motion is to direct defendant to deposit the suit claim amount with interest at 18% p.a. The suit is for a simplicitor money decree. The suit has been lodged on 24th December, 2013. The notice of motion has been lodged on 26th December, 2013. No ad-interim was pressed for. Defendant has filed written statement disputing the liability. Therefore, it is not even the case that defendant has admitted liability. Moreover, the necessary averments in the plaint for an attachment before judgment also is missing.
