By this IA, the original defendant seeks to file Written Statement, which is presently beyond time. True copy of the written statement has been handed over to the learned counsel for the plaintiff in court. 2.

In view of the above and the delay that has occasioned, Ms. Irani opposed the application, however, there is no affidavit-in-reply. 3.

In view of the above, considering the delay and the oral application made today for condoning the delay, I pass the following order :- 1/2 6-IA-2883-2021.doc Dixit

(i) Subject to payment of costs of Rs.25,000/- to the plaintiff by pay order within one week from today, Written Statement be filed in the registry.

(ii) The costs shall be condition precedent and payment of costs to be made on or before 4 th December 2021.

(iii) If costs are not paid within the stipulated time, Written Statement shall not be taken on record.

(iv) IA is disposed in the above terms.
