By the above Application, the Applicant seeks leave of this Court under Section 446 of the Companies Act, 1956 to continue with the proceedings filed before the Labour Court at Valsad. 2.

The learned Advocate appearing for the Respondent Company has submitted that the question of granting leave as sought does not arise since the order directing the winding up of the Respondent Company is recalled by an order dated 16th July, 2013 passed by N.M. Jamdar, J. 3.

In view thereof, the Petitioner is not required to seek the relief
