2] The appeal preferred by the applicant was dismissed as he was not present. The appeal has been admitted on 20th August 2013, considering the averments made in the affidavit in support of the Notice of Motion, a case for restoration is made out. Accordingly, Notice of Motion is made absolute in terms of prayer clauses (a) and (b). 3] The Registry will issue notice of restoration of appeal to the respondent. We grant liberty to the applicant to apply for restoration of ad-interim relief/interim relief after notice of restoration is served to the respondent.
