DATED :- JANUARY 8, 2016 P.C. :- After having heard both sides and finding that all that the Petitioner claims is a reasonable opportunity of hearing so as to establish and prove his claim that he was legally and validly residing in a transit accommodation, we direct the Executive Engineer, E-2 Division, Mumbai Building Repair and Reconstruction Board to pass a fresh order and in accordance with law. That should be done as expeditiously as possible and within a period of four weeks from the date of appearance of the Petitioner. It is agreed that the Petitioner shall appear before the Executive Engineer on 19th January, 2016 at 10.30 a.m. We keep open all contentions of both sides. The Writ Petition is disposed of.
